A Food and drink premises is defined as land used to prepare and sell food and drink for the immediate consumption on, or off the premises. It includes a Take away food premises. The use of a Mobile Food Van complies with this definition and therefore does not require a planning permit. A condition to the use for a Food and Drink Premises is that the leasable floor area must not exceed 100 square metres. As the leasable floor area of the building on the site exceeded 100 square metres, a planning permit was therefore required to use part of the site for the purpose of a Take away food premises (Mobile Food Van).

The planning application was fast tracked and a planning permit was issued. The Mobile Food Van has been successfully operating from the site for over twelve months.
